(Oral) Petitioner herein, who is working as Junior Helper at Electrical Sub Division HPSEBL, Sarahan, District Shimla, Himachal Pradesh, has approached this court in the instant proceedings, praying therein to issue directions to the respondent to consider and decide his representation (Annexure P-2), whereby he has prayed for transfer from present place of posting to a station of his choice on account of his having completed three years at present place of posting. 2. Having regard to the nature of prayer and order proposed to be passed, this court sees no necessity to call for reply from the respondent, who is otherwise represented by Mr. Virender Kanwar, - 2 - Advocate. While putting in appearance on behalf of the respondents, Mr. Virender Kanwar, Advocate, states that representation, if not already decided, shall be decided expeditiously. 3. From the averments contained in the petition, which is duly supported by an affidavit as well as documents annexed therewith, this Court finds that petitioner has completed his normal tenure at present place of posting and as such, is entitled to make request to the competent authority to transfer him to a place of his choice in terms of the transfer policy. 4. Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition with a direction to the respondents to consider and decide the pending representation of the petitioner expeditiously, preferably within a period of four weeks. Ordered accordingly. Needless to say, authority concerned, while affording opportunity of hearing to the petitioner shall also take note of the transfer policy formulated by the Government of Himachal Pradesh, which provides for transfer of an employee from hard area to soft area after his/her having completed normal tenure at present place of posting and pass appropriate orders.
