Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents. 2. The petitioners by means of the present petition have assailed the order dated 22.02.2025 passed by the Member/Secretary District Caste Verification Society/District Social Welfare Officer, District Kushi-Nagar. 3. A preliminary objection has been raised by learned Standing Counsel that against the order impugned, there is a statutory remedy of appeal before the Divisional Level Scrutiny Committee constituted under the Government Order dated 26.03.2011. 4. The aforesaid fact is not disputed by the learned counsel for the petitioner. 5. Since, there is statutory remedy of filing appeal before the Divisional Level Scrutiny Committee against the order impugned, therefore, present petition is not maintainable before this Court. 6. Consequently, the present petition is dismissed on the ground of alternative remedy. 7. However, if petitioner prefers any appeal against the impugned order within a period of one month from today, the Appellate Authority i.e. Divisional Level Scrutiny Committee shall decide the same on merit without entering into the question of limitation. 8. It is further provided that Divisional Level Scrutiny Committee shall decide the appeal of the petitioner expeditiously, preferably within a period Versus Counsel for Petitioner(s) : Ashok Kumar Yadav, Ram Chandra Srivastava Counsel for Respondent(s) : C.S.C.
