Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Daltonganj (Town) P.S. Case No.365 of 2024 registered for the offences punishable under sections 103(1)/61(2)/3(5) of the B.N.S., 2023.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed the murder of Sanjay Prajapati. It is further submitted that the allegations against the petitioner are all false and the deceased trespassed to the house of the petitioner and the allegation against the petitioner is of general and omnibus in nature. It is next submitted that the petitioner has no criminal antecedent. It is then submitted that the petitioner has been in custody since 07.10.2024 as has been mentioned in paragraph no. 13 of the bail application and the petitioner is a female. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that she will not annoy or disturb the informant in any manner during the trial of the case. It is lastly submitted that the co-accused person has already been admitted to bail by a coordinate Bench of this Court vide order dated 24.01.2025 in B.A.
No.471 of 2025. Hence, it is submitted that the petitioner be also admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Palamau at Daltonganj, in connection with Daltonganj (Town) P.S. Case No.365 of 2024 with the condition that the petitioner will cooperate with the trial of the case and will furnish her mobile number and a copy of her Aadhar Card in the court below with the undertaking that she will not change her mobile number during the trial of the case with further condition that she will not annoy or disturb the informant in any manner during the trial of the case.
