GP FOR REVENUE (AP) 4 HBKM,J W.P.No.6502 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in seeking to evict the petitioners from their respective house sites in Sy.No.67, 69, 567 to an extent of Ac.0.03 cents each situated at Nandavaram Village and Mandal, Kurnool District bearing Plot Nos.187, 153, 1, 35, 139, 137, 170, 08, 75, 210, 24, 58 and 204 respectively and to allot the same to the third parties. 3. The learned counsel for the petitioners submits that without initiating the proceedings for assignment of the plots, the respondent authorities are trying to dispossess the petitioners from the subject plots for the purpose of giving it to the third parties/beneficiaries. 4. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 04.08.2025 submits that the writ petitioners and the beneficiaries failed to make any construction of houses or huts in the house sites assigned to them even after 15 years of assignment of the house sites. In order to facilitate the other poor persons, previously the then Tahsildar, Nandavaram decided to change the layout from 0.03 cents to 0.1 ½ cents as per the previous government decision to implement the welfare scheme of providing house sites to the other poor beneficiaries. The 4th respondent also took the statement on 09.12.2019 from 5 HBKM,J W.P.No.6502 of 2020 all the beneficiaries including the writ petitioners, who gave no objection to convert the house sites into 0.1 ½ cents from 0.03 cents and they have given no objections to assign the same to the other poor people. However, the present Government with an intention to implement the scheme “Housing for All”, decided to assign the house sites for poor beneficiaries in an extent of 0.03 cents in Rural Areas. Hence, the action will be taken basing upon the eligibility, because the writ petitioners and the beneficiaries failed to make any construction of houses or huts in the house site pattas for the last 15 years. 5. In view of the above said facts and circumstances and upon consideration of the rival submissions made, the respondent authorities concerned are directed to proceed with the subject house sites strictly in accordance with law and if the petitioners are otherwise found to be in possession of the same, they shall be dealt with strictly in accordance with law by following the due procedure. 6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Interim order, if any, deemed to have been vacated.
