JUSTICE ALOK KUMAR SINHA ORAL ORDER 2 28-03-2025 Heard the parties. 2. The petitioners in the present writ application prays for the grant of following reliefs:- i) For direction upon the respondent authorities to implement the judgment/order dated 26.04.2024 passed in LPA No.-458/2021 (arising out of CWJC No.-1744/2020) by the Division Bench of this Hon'ble Court in respect of the petitioners of the present writ application also as they are similarly situated to the appellants/petitioners of LPA No.-458/2021 and extend them all consequential benefits i.e. refund of recovered amounts, if any and restore the pay- fixation in the light of the facts that the petitioners were/are entitled to 1 ACP in the scale of Rs.4000-6000/- which was already allowed to them by the respondents. Patna High Court CWJC No. 4760 of 2025(2) dt.28-03-2025 5/7 ii) To hold that petitioners are covered by the judgment/order dated 26.04.2024 passed by the Division Bench of this Hon'ble Court in LPA No.-458/2021 and therefore, as per Clause-4.C (1) of the Bihar Litigation Policy, 2011 issued under resolution dated 31.03.2011 by the State Govt. they are also entitled to be given the same and similar benefits as has been given to theappellants/petitioners of LPA No.-458/2021 and any discrimination with the petitioners would amount violation/breach of the Bihar Litigation Policy, 2011 by the respondent authorities. To iii) For any other relief/reliefs to which the petitioners are entitled to in the facts and circumstances of this case. 3. The learned counsel for the petitioners submits that their case is squarely covered by a judgment of this Court delivered on 26.04.2024 in LPA No. 458 of 2021 arising out of CWJC No. 1744 of 2020 (Annexure-P/6) and in light of the same, the petitioners have already filed several representations before the Director General of Police Bihar, Patna, one such representation is annexed as Patna High Court CWJC No. 4760 of 2025(2) dt.28-03-2025 6/7 Annexure-P/10 at page 85 of the writ application. Similar such representations have also been filed by other petitioners of this case. All the representations are said to be still pending before the Director General of Police Bihar, Patna. 4. With the consent of parties, this writ application is disposed of directing the Director General of Police, Bihar, Patna to dispose of all the representations filed by the petitioners in which the petitioners have relied upon the judgment and order of this Court dated 26.04.2024 in LPA No. 458 of 2021 arising out of CWJC No. 1744 of 2020 (Annexure-P/6) for grant of reliefs to them. If the Director General of Police Bihar, Patna finds that the reliefs being sought by the petitioners are actually squarely covered by the judgment of this Court then the reliefs sought by the petitioners should be granted to them within a reasonable time and if not, then the representations of the petitioners should be decided by passing a detailed and speaking order. The Director General of Police Bihar, Patna should dispose of all the representations of the petitioners within two months from the date of production Patna High Court CWJC No. 4760 of 2025(2) dt.28-03-2025 7/7 of copy of this order. The petitioners would be at liberty to challenge in case their representations are dismissed by the Director General of Police, Bihar, Patna. 5.
