SEMA ORDER Date : 08.04.2025 (P. J. Saikia, J) 1. Heard Mr. N. Mahajan, learned counsel for the applicant. Also heard Ms. S. Jahan, learned Additional Public Prosecutor for the State of Assam. 2. The present application has been filed under Section 430(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for suspension of sentence. 3. The applicant Pukun Chouhan was convicted under Section 302 of the Indian Penal Code and he was sentenced to undergo rigorous imprisonment for life on 08.08.2023 by the learned Sessions Judge, Dima Haso, Haflong in Sessions Case No.22/2019. 4. Today Ms. Jahan, learned Additional Public Prosecutor has filed a report sent by the superintendent of Central Jail, Silchar, this status of the applicant is suffering from cancer in his mouth and for cancer no treatment is yet to be given to the applicant. 5. Learned counsel for the applicant submits that the condition of the applicant is deteriorating day by day. 6. Having considered the submissions made by learned counsel for both the sides. 7. This Court is of the opinion that the prayer of the applicant deserves to be Page No.# 3/3 allowed. 8. The report filed by Ms. Jahan, learned Additional Public Prosecutor marked as “X” and shall a form a part of the record. 9. It is hereby directed that the sentence imposed upon the applicant Pukun Chouhan by the learned Sessions Judge, Dima Haso, Haflong in Sessions Case No.22/2019 shall remain suspended till disposal of the connected Appeal. 10. On medical grounds, the bail prayer of the applicant is also allowed. 11. The petitioner Pukun Chouhan, shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned lea Sessions Judge, Dima Haso, Haflong. 12.
