JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 3 15-09-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Bhargama P.S. Case No. 201/2024 dated 01.07.2024 registered for the offence punishable u/s 103 read with Section 3(5) of the B.N.S.
3. As per the prosecution case, when the informant's husband was ploughing Suman Kumar's field with the tractor. In the meantime, the petitioner and the co-accused persons came holding arrow, lathi, farsa, dabiya and kudal and started abusing and the co-accused, Ramvilash Yadav ordered to kill. On hearing this, the petitioner shot an arrow which hit on the throat

Thereafter, the co-accused, Kapildeo Yadav assaulted the informant's husband with the iron rod on the back side of his neck. When the informant along with her family members reached at the place of occurrence, the informant saw the accused persons fleeing away from there and saw her husband dead. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.08.2024. 5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the bail petition of the petitioner by submitting that the specific allegation of shooting the arrow is against the petitioner. 30 of the case diary, the post-mortem report of the deceased is mentioned in which cause of death is due to arrow hitting his throat. 6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.31557 of 2025(3) dt.15-09-2025 3/3 of the case as well as the specific and heinous nature of offence against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Bhargama P.S.
