3. The case of the-'prosecution, in brief, is that, the defacto complainant is working as a cluster Head for Vijayawada Region in Karnataka Bank Limited and he will supervise all the branches under this region and report the same to his Higher Authorities.
During the course of thel'r regular branch inspection, their inspecting staff visited Karnataka Bank Limited, Ramanaidupet Branch on 27.01.2025 and during his inspection on preliml'nary scrutl'ny out of 504 gold loan packets, they found 34 gold loan pockets (approximately rupees one crore sixty lakhs) pertainl'ng to various loan account holders were found missing and the same I'S admitted by the Assistant Branch Manager/Al namely G.Somasekhar who informed to the auditing officl|als that he pledged the same in various NBFCs, on that, bank authorities are also making further investigation internaIIy to ascertain further loss if any. Then, immediately inspector informed about the theft to higher authorities and making their efforts to trace out the stolen gold packets as the Assistant Branch Manager is a joint custodian of all the safe deposit articles I'nCIuding gold kept in double lock and he misued his powers and took the gold from double lock which belongs to customers and stolen the gold pockets when holdI'ng One Of the key of double lock of the branch while he l's entrusting duties and ` -=`- rs5E=-E
3 he is working from 25.o5.2022. After registration of FIR during investigation, the accused No.1/Assistant Branch Manager admitted that his brother na'mely Harish who is petitioner/A2 helped him for taking loans from NBFCs (Non Banking Financial Companies), on that, he pledged some of the gold ornaments in few NBFCs on his name, obtained loans and spend money towards his betting habit. 4. Heard. Perused the record. 5. The learned counsel for the petitioner/A2 submits that the case was registered solely based on the confessional statement of A1, who is his brother. UPon inquiry, the learned Assistant Public Prosecutor brought to the notice of this Court that, except for the confessional statement, no other material has been brought on record to array the petitioner as an accused.
On the other hand, as seen from the orders passed in CrI.M.P.No.225 of 2025, the learned Magistrate, while allowing the petition, observed that the major part of the investigation had been completed. lt is noted that the wife of Al filed a Habeas Corpus petition in W.P.No.2611 of 2O25. The petitioner/A2 contends that after the filing of the writ petition, the police hastily registered a case against Al and bore a grudge against his family, +`~ __ `=* r=---E
4 implicating the petitioner as A2, as if A1's confession attributed the same role to A2. The material placed on record indicates that most of the investl'gation has been completed. The learned counsel for the petitioner submits that the petitioner is employed by VMC, and in the event of his arrest, he may face departmental action. When ascertained, the learned Assistant Public Prosecutor confirmed that the petitioner has no prior antecedents. 6. In view of the said reasons, this Court is inclined to grant anticipatory bail to the petitioner/A2. 7. Accordingly, the petitioner/A2 is directed to surrender before the Station House Officer concerned within two (2) weeks from today and on such surrender, the petitioner shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction` of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses.
