The challenge in this petition is made to the order dated 18.06.2025 passed by the respondent no. 4/Divisional Forest Officer, Narendra Nagar Forest Division, Muni-Ki-Reti, Tehri Garhwal, by which the claim of the petitioner for regularization has been rejected on the ground that the operation of the Rules has been stayed by the
order of the Court.

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner submits that the interim order of the Court has already been vacated and the Rules are in operation, but in the impugned order, this aspect has not been adverted to. He submits that para 5 of the impugned order records that the petitioner is otherwise entitled for regularization.

Learned State Counsel, who was required to get instruction, submits that the concerned officer has conceded to his error and he undertakes to withdraw the impugned order and pass a fresh order. The written instruction received by the learned State
2 Counsel has been tendered to this Court for perusal. The same is taken on record.

The instruction records that it was a bona fide mistake and the claim of the petitioner could not be considered. The concerned respondent, therefore, seeks permission to withdraw the impugned
order so as to consider the claim of the petitioner afresh.

Permission is accorded.

Learned State Counsel submits that the claim of the petitioner shall be considered and decided within two weeks.

In view thereof, the writ petition is disposed of with the direction to the respondent no. 4/Divisional Forest Officer to proceed with the matter and consider the claim of the petitioner afresh, as per rules, within two weeks from today.
