The petitioner has been made accused in connection with Chandwa P.S. Case No. 26 of 2025, for the offence registered under Sections 310(2)/ 310(6)/311 of Bharatiya Nyaya Sanhita, 2023 and Section 17 of the CLA Act, pending in the court of learned Additional Chief Judicial Magistrate, Latehar. On 27.01.2025 at about 9:00 p.m., 8 to 9 extremists came to the brick-kiln of the informant and demanded levy. The accused persons also fired to enforce their demand. The accused persons looted the motorcycle and mobile phone of the informant. It is alleged that the accused persons committed loot in several brick- kilns, which were located nearby. It is further alleged that the people of locality gathered and apprehended three persons. It was submitted that though petitioner is named in the F.I.R., but his name has transpired in the confession of co-accused, who were apprehended at the spot. It was further submitted that petitioner has not been put on T.I. Parade and nothing has been recovered from his possession. Learned A.P.P on behalf of the State submitted that the name of the petitioner has come in the extra judicial confession of co-accused persons. Considering the nature of allegation, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Latehar, in connection with Chandwa P.S.
