2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 60 liters illicit liquor was recovered from a motorcycle without number plate.
4. Learned counsel appearing for the petitioner submits that he has been falsely implicated in this case. He is neither owner nor driver of the motorcycle. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery.
5. Learned A.P.P. for the State submits that 60 liters
Patna High Court CR. MISC. No.5587 of 2025(2) dt.25-02-2025 2/2 illicit liquor was recovered from a motorcycle. Besides this, the petitioner has got four criminal cases of similar nature.
6. Considering the quantity of recovery and criminal antecedent of similar nature, the anticipatory bail application of the petitioner is rejected.
