1. Mr. Avidit Noliyal, learned counsel for the applicant.
2. Mr. V.S. Pal, learned A.G.A. for the State.
3. Present applicant Akash, S/o Pradeep is praying for bail in relation to FIR dated 20.01.2022, bearing FIR No. 0072 of 2022, registered as P.S. Kotwali Roorkee District Haridwar wherein the present applicant along with two other co-accused, namely, Gaurav @ Babbar and Shiva have been implicated and charge sheeted for the offences punishable under Sections2/3 of U.P. Gangsters and Anti Social (Prevention) Act 1986.

It is submitted by the learned counsel for the applicant that by showing three cases against the present applicant he has been implicated and in all three cases as shown in the gang chart applicant is already bailed out. He further submits that charge sheet has already been filed, and, in fact, the applicant is languishing in jail since last more than three years.
5. On the other side, Mr. Pal, learned A.G.A. for the State has not disputed this fact that charge sheet has already been filed and in all the previous cases the applicant is already bailed out. He further submits that as per the gang chart, the gang leader is Gaurav @ Gabbar.
6. After hearing the learned counsel for the parties and further taking into
consideration that the charge sheet has already been filed and in the previous cases, on the basis of which applicant has been implicated in the present case, the applicant is already bailed out, this Court is of the view that the applicant deserves

7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant Akash be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
9. However, keeping in view the fact that the first case against the applicant is of the year 2016 and since then he is indulged in criminal activities, he is
directed to report to the concerned nearest police station in every 15 days and the concerned S.H.O. shall record his presence failing which the Trial Court will immediately take action against the applicant and cancel the bail.
