The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to pay interest on delayed release of provident fund.

The petitioner claims that he was dismissed from service on 19.09.2021 whereas provident fund was released on 16.05.2024. Thus, he is entitled to interest for the delayed period.

Mr. Raman Sharma, Additional Advocate General, Haryana submits that as per applicable Rules, interest on provident fund is stopped on expiry of one month from the date of dismissal of an employee. The petitioner was dismissed from service, thus, interest on provident fund was stopped on the expiry of one month from the date of dismissal. The interest is compensatory in nature. The respondent is liable to pay interest on delayed payment of provident fund. The respondent stopped calculating interest on the expiry of one month from the date of dismissal of the petitioner. An employee despite being dismissed from service is entitled to provident fund. The amount of provident fund could not be withheld. The respondent released said fund on 16.05.2024, thus, it was liable to pay interest @7.1%. Accordingly, it is hereby directed that respondent shall pay interest to the petitioner @7.1% on delayed payment of provident fund.
