1. By the present writ petition, the petitioner is seeking a direction towards the respondent no. 2/Municipal Corporation to take action on the representation dated 26.12.2024 (Annexure P/1) and take necessary steps pursuance to order dated 26.07.2021 passed by the SDO (R) on the application filed by the petitioner under Section 133 of Cr.P.C. against the respondent no. 5 & 6.

Learned counsel for the petitioner would submit that the petitoner has filed an application under Section 133 of Cr.P.C. on 06.11.2019 before the SDO seeking a direction towards the respondent no. 5 & 6 to remove the illegal garbage stored behind the door of the petitoner’s house. The SDO vide its order dated 26.07.2021 allowed the application of the petitoner and directed the private respondents to remove the garbage stored behind the door of the petitioner’s house. Learned counsel for the petitioner would submit that in spite
3 of the request made by the petitioner to respondent authority including the Commissioner for compliance of the order dated 26.07.2021, the private respondent No 6 & 7 are not removing the garbage which has been stored behind the door of the petitioner’s house.
3. Learned State counsel would submit that the SDO has passed an
order dated 26.07.2021 and as the petitioner is alleging that the
order of the SDO is not being complied with. The respondent SDO shall look into the grievance of the petitioner and necessary steps will be taken.
4. I have heard both the counsels for the parties and perused the pleadings of the petitioner and representation submitted by the petitioner to the Corporation as well as the photographs.
5. It appears from the photographs that the alleged garbage is still lying behind the door of the petitioner and the SDO has already passed an order and the petitioner has also sent the copy of the representation dated 24.12.2024 to the SDO vide (Annexure P/1). It is directed that the SDO/respondent no. 3 shall look into the grievance of the petitioner and take necessary steps within a period of 20 days from today.
6. With the aforesaid direction, the writ petition is disposed of. Sd/-
