JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 15-09-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. 2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 8(c), 21(b) and 22 of the N.D.P.S. Act. 3. As per prosecution case, it is alleged that 7 grams of smack was recovered from possession of co-accused Asha Devi and Lalu Kumar who disclosed the name of this petitioner, who is their nephew and allegedly procured the seized contraband. It is further alleged that a smartphone, belonging to this petitioner, was also recovered from possession of co- accused Asha Devi. 4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has Patna High Court CR. MISC. No.62240 of 2025(2) dt.15-09-2025 2/2 committed no offence. No incriminating article has been recovered from possession and he has falsely been implicated in this case merely on the basis of disclosure made by apprehended co-accused persons. Petitioner claims clean antecedents. 5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R.. 7 grams of smack was recovered from possession of co- accused persons which was procured by this petitioner. One smartphone of this petitioner was also recovered from possession of co-accused persons. 6. Considering the facts and circumstances of the case and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected. shashank/- (Prabhat Kumar Singh, J) U T
