The writ petition is filed challenging the action of the respondents in proposing to issue the house site pattas in respect of the subject property belonging to the petitioners situated in Sy.No.179-7, 187-2, 179-7, 184 at Lakshmipuram Village, Palasa Mandal, Srikakulam District, without following due process of law. 2. It is contended that the petitioners have purchased the following house site pattas:
1. The 1st petitioner purchased house site of 150 Sq. Yards in Sy.No.179-7 through a registered sale deed dated 30.05.2002. 2. The 2nd petitioner purchased house site of Ac.0.03 cents in Sy.No.187-2 through a registered sale deed dated 04.06.1984. 3. The 3rd petitioner purchased 50 Sq. Yards, wherein house was existing.. 4. The 4th petitioner purchased a house site of 226 Sq. Yards in Sy.No.179-7 through a registered sale deed dated 19.05.2016. 3. However, the 4th respondent attempted to dispossess the petitioners of their land to issue house site pattas in favour of the beneficiaries of the Scheme viz., "Navarathnalu-Pedalandariki Illu". Thus, they have approached this court by way of instant writ petition. 4. This Court, vide order dated 17.03.2020, granted an interim order, directing the respondents not to grant house site pattas in respect of the subject land under the "Navarathnalu-Pedalandariki Illu" scheme and to maintain the status quo as it existed on that date. 5. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader for Revenue has placed on record a copy of the written instructions received from the 4th respondent dated 23.11.2024, stating that in terms of the interim directions of this Court, subject land of the petitioners is vacant on ground and is intact. 6. The said written instructions of the Tahsildar-4th respondent dated 23.11.2024 are placed on record. 7.
In view of the foregoing, the respondents are directed not to dispossess the petitioners from the subject land without due process of law, since the petitioners have purchased the property through a registered sale deed, they have a legitimate right to occupy the land. If their possession is found to be unauthorised, the respondents shall not dispossess the petitioners without following the due procedure under law. 8. With the above observation, the writ petition is disposed of. There shall be no order as to costs.
