(Oral) The instant petition has been filed for seeking a direction to the respondents to conduct a fair and time bound inquiry in GD NO. 26 dated 02.01.2025, recorded at Police Station, Dinanagar, District Gurdaspur (Annexure P-3), arising out of FIR bearing No.180 dated 09.12.2024, under Sections 125, 118(1), 115(2), 191(3), 190, 351 of the Bharatiya Nyaya Sanhita, 2023 and under Sections 25 and 27 of the Arms Act, registered at Police Station, Dinanagar, District Gurdaspur (Annexure P-2). RAJ KUMAR ARORA 2025.09.04 19:07 I attest to the accuracy and integrity of this document CRM-M-47748-2025 (O&M) -2- 2 Learned counsel appearing on behalf of the petitioner contends that the petitioner-complainant runs a furniture shop, taken on rent from the accused. The respondents wanted the petitioner to vacate the said shop before the expiry of the period of agreement. The petitioner thus filed a suit for permanent injunction. Notwithstanding, pendency of the civil proceedings, the accused caused beatings to the petitioner and his sons. He contends that the respondent authorities are not taking any action in order to shield the accused. He further submits that the petitioner had earlier approached this Court vide CRM-M-10275 of 2025 titled “Jaswant Singh Vs. State of Punjab and others” for seeking directions to the respondents to take appropriate action against the accused persons. The said writ petition was disposed of vide order dated 24.02.2025 and it was incorporated therein that the investigation should be completed expeditiously if there is no other legal impediment. He further contends that despite lapse of a period of more than six months, the investigation has not yet been concluded. 3 Having heard the learned counsel appearing on behalf of the petitioner, I find that the petitioner under the garb of present petition wants to steer the pace of investigation and to make a follow up on the investigation. The said aspect can also be looked into by the Illaqa Magistrate under the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4 It would thus not be feasible for this Court to be entertaining such petitions when the petitioner has an efficacious remedy. 5 The present petition is thus disposed of with liberty to the RAJ KUMAR ARORA 2025.09.04 19:07 I attest to the accuracy and integrity of this document CRM-M-47748-2025 (O&M) -3- petitioner to approach the concerned Illaqa Magistrate for any such or similar directions and/or seeking status of the investigation in the said FIR.
