HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 32128 of 2025 Court No. - 34 HON'BLE ROHIT RANJAN AGARWAL, J.
1. This writ petition has been filed with the following prayer:
"i) Issue a writ, order or direction in the nature of mandamus directing the directing the respondents to decide the application dated 05.07.2025, pending before respondent no. 3 within specific and stipulated period, fixed by this Hon'ble Court. ii) Issue a writ, order or direction in the nature of mandamus directing the directing the concerned respondents to get the physical over the Araji No. 799-ग, area 0.174 hectare situated at village Tabar Must, Pargana Sarsawa, Tehsil Nakud, District Saharanpur."
2. It is contended that the petitioner was the given lease of the land in question way back on 24.05.1976. The application for cancellation was moved before the Additional Collector which was decided in the year
1992. Thereafter, a reference was made by the order of the Additional Commissioner in the year 1992 itself. The matter was finally decided by the Board of Revenue on 26.11.1994. The petitioner claims that the matter having been decided by the Board of Revenue, till date the possession has not been handed over.
3. Learned Standing Counsel, on the contrary, submits that almost 31 years have elapsed and the petitioner has approached this Court at very belated stage.
4. From the perusal of material on record, it transpires that the petitioner is relying upon an application moved on 05.07.2025 before the authorities Versus Counsel for Petitioner(s) : Faizur Rahman Counsel for Respondent(s) : C.S.C., Kaushal Kishore Mani Dharamveer Singh And Another .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s)
making a complaint. Nowhere in the writ petition, the delay has been explained for approaching this Court after 31 years after the reference was decided by the Board of Revenue. No case for interference is made out.
5. The writ petition is misconceived and stands dismissed. September 15, 2025 A. V. Singh WRIC No. 32128 of 2025 2 (Rohit Ranjan Agarwal,J.) Digitally signed by :- AJAY VIKRAM SINGH High Court of Judicature at Allahabad
