AMARNATH GOUD ORDER 07.07.2025 Heard learned counsel for the respective parties. [2] This present petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “i(i) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Official Respondents to sanction and release regular monthly pension, full and final payment of gratuity, leave encashment benefit and other pensionary benefits. (ii) Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to release and sanction the pensionary benefits of the Petitioner after remitting Rs. 25,00,000/- from the pensionary benefits of the Petitioner to the loan account of the Petitioner lying with the TSCB Ltd, Battala Evening Branch, Agartala. (iii) Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the bank to accept Rs. 25,00,000/- as OTS amount to close the loan account as has been offered by letter, 05.05.2025 issued by Managing Director, TSCB Ltd. Battala Evening Branch, Agartala and to extend the date of OTS from 31st May2025 to 31 July 2025 due to circumstances beyond the control of the Petitioner, he could not deposit such amount within 31st May, 2025. (iv) Make the rules absolute. (v) Call for records.” [3] It is seen from the record that the petitioner herein submitted a letter dated 13.05.2025 and a legal notice dated 07.06.2025 through his engaged counsel addressed to the concerned respondents regarding his grievances but the petitioner herein till today got no positive response from the concerned respondents. [4] Without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the respondent No.3 i.e. Director of Health Services, Govt. of Tripura to consider the case of the petitioner in light of the letter dated 13.05.2025 and a legal notice dated 07.06.2025 within a period of 02 (two) months from the date of receipt of the copy of this order, in accordance with law. With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
