-2- 1) Heard on application for restoration of Second Appeal which was dismissed on account of peremptory order passed by this Court in Second Appeal No.504 of 2024 on 16.10.2024. 2) Mr. Ruparel, the learned counsel appearing for the applicants would submit that in Second Appeal No.504 of 2024, two weeks time was granted to make the default good and there was a peremptory order. He would further submit that due to inadvertence, the default pointed out by the Registry could not be rectified and consequently, the Second Appeal was dismissed. He would contend that the applicants have a good case on merit and they are interested in pursuing it. 3) On the other hand, Mr. Agrawal, the learned Panel Lawyer appearing for the State would oppose the submissions made by Mr. Ruparel. 4) Taking into consideration the submission made by Mr.Ruparel, Second Appeal No.504 of 2024 is restored to its original number subject to payment of cost of Rs.1,000/- payable to the High Court Bar Association Library Fund. 5) MCC stands disposed of.
