(ORAL) Petitioner seeks regular bail in case arising out of FIR No. 71 dated 01.05.2025, under Sections 6, 17 of Protection of Children from Sexual Offences Act, 2012 and Sections 308(2), 317, 61(2) Bharatiya Nyaya Sanhita, 2023, Police Station Civil Lines Gurugram. This is his first petition for regular bail. Mother of the prosecutrix, alleged that in March 2024, Nitin Sehrawat, met her minor daughter ‘P’, a student of Class 11 and allured her. He began sending messages to her, whereafter he started demanding money everyday. Her daughter gave him 7-8 lacs rupees from home, besides 04 gold bangles weighing 16 tolas, one gold bracelet weighing 04 tolas, one gold chain, one maang tikka weighing 1/2 tolas and one Rani Haar. He had forcible sex with her on five occasions and whenever she refused, he raised demands for more money. He also made her transfer money online through Paytm accounts to the accounts of his friends Lovely Kalyan, Rahul Athwal, Dev Lathwal and Naveen. When they discovered the online transfers, a complaint was filed with Cyber Crime and the accounts were blocked. That day, when she was going to her nephew’s wedding, she found her jewellery missing. On enquiry, it was revealed that Nitin Sehrawat had taken away the jewellery by blackmailing her daughter. He had sent his friend Aman Yadav to collect jewellery from the house. Some of that gold was pledged in the bank. He also took away her son’s expensive wrist watch. Some of the gold was pledged in Mannapurum Gold OGL Lite with ID No. 27720021037287. Learned counsel for the petitioner argued that offences under Sections 6 and 7 of Protection of Children from Sexual Offences Act, 2012 were invoked against co-accused Nitin Sehrawat and petitioner was involved only under Section 317 BNS for having received stolen property. Referring to statement of the prosecutrix recorded under Section 183 BNSS he submitted that there was nothing in the statement regarding role of the petitioner in the alleged sexual exploitation of the minor child. He was in custody for the last 05 months. Challan has been presented. Trial would take long to conclude. It was thus, prayed that petitioner be released on regular bail. Learned State counsel assisted by learned counsel for the complainant opposed the prayer for regular bail. Learned State counsel, however, concedes that the role attributed to the petitioner was of receiving stolen property. He submits that a sum of Rs. 2,00,000/- was recovered from possession of the petitioner and a valuable wrist watch taken from the victim was produced by his mother. Petitioner is in custody for the last 05 months. Challan has been presented in the case. Trial is likely to take some time to conclude. In the given facts and circumstances of the case, but without commenting on the merits, the petition is allowed. Petitioner-Aman Singh, is ordered to be released on regular bail on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate concerned.
