Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging the Order dated 30.01.2025, passed by the Page No.# 2/2 learned Sessions Judge, Bongaigaon in Criminal Revision Case No.12/2024. 3. Certain quantity of Areca Nuts were seized in this case and during the period of investigation, the learned Judicial Magistrate, Bongaigaon gave custody of the seized Areca Nut to the present petitioner. Thereafter, the Investigating Officer moved the Court of Sessions by filing a Revision Petition and the Revisional Court set aside the order of the Magistrate given the custody of the seized Areca Nuts to the present petitioner. 4. Leaned Additional Public Prosecutor has submitted that the Charge-Sheet has already been filed by Police being Charge-Sheet No.20/2025 dated 30.04.2025. 5. Since the Charge-Sheet has been filed, this Court is of the opinion that keeping the seized Areca Nuts would not serve any purpose. 6. Therefore, the Order of the learned Sessions Judge, Bongaigaon dated 30.01.2025 passed in Criminal Revision Case No.12/2024 is set aside. 7. The seized Areca Nuts be given in custody of the present petitioner on taking a bond of Rs.50,000/-. 8. With the aforesaid direction, the Criminal Petition stands disposed of.
