PUBLIC PROSECUTOR The Court made the following: ORDER: The petition is filed seeking for relaxation of the conditions imposed by the learned Judicial Magistrate of I Class (SMC), Kurnool, dated 03.01.2025, wherein the petitioner was directed to appear before the Station House Officer concerned on every Saturday between 10:00 am and 05:00 pm for a period of three (03) months or till the filing of the charge sheet, whichever is earlier. 2 2. It is represented that the petitioner has completed the period of three (03) months, yet the Station House Officer is insisting for the appearance of the petitioner. 3. Heard the arguments of the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 4. I have perused the record. 5. Obviously, the petitioner has completed the period of three (03) months, but the charge sheet is not yet filed. However, as per the direction of the learned Magistrate, the investigating officer concerned is not supposed to insist for the appearance of the petitioner on every Saturday. Therefore, the order dated 03.01.2025, passed in Crl.M.P. No.319 of 2024 in Cr. No.214 of 2024 of Kodumur Police Station by the learned Judicial Magistrate of I Class (SMC), Kurnool, at paragraph No.5, Clause b is modified and the investigating officer/ Station House Officer, Kodumur Police Station is directed not to insist the presence of the petitioner. 6. In the result, the Criminal Petition is disposed of. There shall be no orders as to costs. As a sequel, miscellaneous petitions, if any pending, shall stand closed. _________________________ Dr. Y.
