PUBLIC PROSECUTOR 2 HN,J Crl.P.No.2378 of 2025 The Court made the following Order: The learned counsel for the petitioners submits that the S.C.No.72 of 2019 on the file of Senior Civil Judge, Palamaner, is coming up for fixation of the schedule for commencement of trial. 2. It is submitted that the 3rd petitioner herein shall appear before the Sessions Court and for the other petitioners’, their presence may be dispensed with subject to their filing of the application under Section 228 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. 3. Considering the submissions of the learned counsel for the petitioners, the learned Sessions Judge shall dispense with the presence of the petitioners on filing of their application under Section 228 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 and the presence of the petitioners shall be informed as when required by the learned Senior Civil Judge, Palamaner in S.C.No.72 of 2019. 4. With the above said observation, this quash petition is disposed off.
