The petitioners have filed the present petition under Articles 226/227 of the Constitution of India with a prayer to issuance a writ in the nature of mandamus directing the respondents to forthwith release the amount of interest on parity basis on account of delayed release of arrears of revised pay scales to the petitioners w.e.f. 01.01.2006 to 31.07.2009. 2. Learned counsel for the petitioners contends that the petitioners have already submitted a legal notice dated 18.12.2024 (Annexure P-6) to the respondents for the afore-said relief, but no action has been taken on the said relief. He further contends that the case of the petitioners is covered by the law laid down by this Court in the matter of CWP No.32357-2019 titled as “Nishant Kumar and another Vs. State of Punjab and others”. He further submits that he shall be satisfied, in case appropriate directions are issued to respondent No.1 to decide the legal notice dated 18.12.2024 (Annexure P-6) in a time bound manner, in accordance with law. 3. On the asking of the Court, Mr. Charanpreet Singh, AAG, Punjab, who is present in the Court, accepts notice on behalf of respondents-State and has no objection to the limited prayer made by learned counsel for the petitioners. 5. I have heard learned counsel for the parties and perused the record. 6. After hearing learned counsel for the parties, it would be appropriate to direct respondent No.1 to decide the legal notice dated 18.12.2024 (Annexure P-6), submitted by the petitioners, within a period of four months, from the date of receipt of certified copy of this order by passing a speaking and well reasoned order. It is expected that before passing the order, respondent No.1 shall take into consideration the law laid down by this Court in CWP No.32357-2019 titled as “Nishant Kumar and another Vs. State of Punjab and others” and Circular dated 03.07.2025 (Annexure P-7) as well as the relevant rules/instructions in the settled law. In case, the petitioners are found entitled to any consequential benefits, the same shall also be released to them, forthwith. 7. The present petition is disposed of, accordingly.
