Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. By means of the present writ petition, the petitioner has prayed for the following relief:- "1. Issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 to 4 to restrain the respondent nos. 5 to 7 from making interference in the peaceful possession of the petitioner on his land of Gata No. 437 situated in Village Semra Chandrauli, Pargana Haveli, Tehsil Sadar, District Maharajganj till the decision of Original Suit No. 74 of 2019 (Rajat Lal vs. Gobari Yadav) pending in the court of Civil Judge (Junior Division), Maharajganj." 3. The reliefs sought by the petitioner essentially pertain to a private dispute between the petitioner and respondent Nos. 5 to 7, who are private individuals. If the said respondents are interfering with the possession of the petitioner, the appropriate remedy lies under the civil law. This Court, in exercise of its writ jurisdiction, cannot issue a writ of mandamus against private respondents. 4. In view of the aforesaid, the writ petition is devoid of merit and is accordingly dismissed with liberty to the petitioner to avail appropriate remedy as may be available to him under law.
