The instant criminal misc. petition has been filed under Section 528 of the BNSS, 2023 seeking modification of the order dated 27.06.2022 passed in ABA No. 3346 of 2022 by which the anticipatory bail of the petitioner was allowed and he was directed to surrender before the court below within four weeks from the date of that order, but the petitioner did not surrender before the court below within the stipulated time. Subsequently, the petitioner filed Cr.M.P. No. 3288 of 2022 for extension of time to surrender before the Trial Court which was also allowed on 03.02.2023 but till date, the petitioner did not appear before the Trial Court and the instant criminal misc. petition has been filed for further extension of time. 2. Having heard learned counsel for the parties, I do not find any merit in this criminal misc. petition and is, accordingly, rejected. 3. However, the petitioner is directed to surrender before the Trial Court within two weeks from today. 4. Learned Trial Court is directed to take all coercive measures/ steps in accordance with law so as to secure the presence of the petitioner. (Gautam Kumar Choudhary, J.) AKT/Pawan/ -
