JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 21-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. Petitioner seeks regular bail in connection with Narayanpur P. S. Case No. 13 of 2024 in a case registered for the offence punishable under Section 304B, 494/34 of the Indian Penal Code. 3. As per the prosecution case, the petitioner is the husband of the deceased and as per fardbeyan, the deceased was living in her in-laws house with three children. In 2024, the husband got married to another lady. When the deceased protested against the relationship, the petitioner along with other accused persons assaulted and demanded motorcycle. Upon refusal, this petitioner along with other accused persons killed the deceased. Patna High Court CR. MISC. No.89597 of 2024(2) dt.21-02-2025 2/2 4. Learned counsel for the petitioner submits that the allegation is general and omnibus against the petitioner. The informant is not an eye witness and has implicated the petitioner in this case merely because he is the husband of the deceased. The Petitioner has not solemnized the second marriage with any lady. As a matter of fact, the deceased committed suicide. The petitioner is in custody 13.05.2024. Chargesheet has already been submitted. 5. Learned counsel for the State and informant opposed the bail application and submitted that the specific accusation against the petitioner is that he demanded motorcycle as dowry. Upon refusal, he along with other accused persons killed the deceased. It was unnatural death in matrimonial house. It was alleged that the petitioner along with other accused persons strangulated the deceased. 6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioner is rejected. kiran/- (Prabhat Kumar Singh, J) U T
