Criminal Miscellaneous 3rd Bail Application No. 3405/2025 Ravi Kumar Gurjar S/o Shri Hazari Lal, Aged About 36 Years, R/o Behind Government School, Saloda Near Karauli Fatak, Gangapur City, P.s. Udayimod -Dist. Sawai Madhopur. (Presently Lodged In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mohd. Umar Farooq, Adv. Mr. S. S. Hora, Adv. For Respondent(s) : Mr. Onkar Singh Rajpurohit, PP HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA Order 15/04/2025 1. These 3rd bail applications have been filed under Section 483 of B.N.S.S. by the petitioners in connection with FIR No.409/2020 registered at Police Station Kanota, Jaipur City (East) for the offences under Section 302 IPC (later on offence(s) under [2025:RJ-JP:16031] (2 of 3) [CRLMB-2286/2025] Sections 302, 201, 323 & 341/34 IPC were found to have been made out). 2. Learned counsel for the petitioners submit that the petitioners have been falsely implicated in this case. They are behind the bars since 14.01.2021. Charge-sheet have been filed against the petitioners. Learned counsel for the petitioners also submit that during investigation, statement of the petitioners under Section 164 Cr.P.C. were recorded. There is no direct evidence that petitioners were ever involved in the crime. The present case rests on circumstantial evidence. Out of 30 witnesses, statements of 14 witnesses have been recorded by the trial court so far. Similarly situated co-accused Kailash Chand has been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 18.07.2024 passed in Criminal Miscellaneous IInd Bail Application No.12140/2023. Case of the petitioners is similar to Kailash Chand. Conclusion of trial may take long time. So, the petitioners be enlarged on bail. 3. Learned Public Prosecutor appearing for the State has opposed the arguments advanced by learned counsel for the petitioners and submits that petitioners and other co-accused persons with connivance murdered Subodh Kumar. So, these 3rd bail applications filed by the petitioners be dismissed. 4. I have considered the arguments advanced by learned counsel for the petitioners as well as learned Public Prosecutor. 5. Petitioners and other co-accused persons with connivance had committed murder of deceased Subodh Kumar and to destroy the evidence, they hanged him. So, looking to the nature of [2025:RJ-JP:16031] (3 of 3) [CRLMB-2286/2025] allegations and gravity of the offences levelled against the accused-petitioners, I do not consider it a fit case to grant bail to the accused-petitioners. 6. Hence, these 3rd bail applications filed by the petitioners stand dismissed. (NARENDRA SINGH DHADDHA),J Jatin /02-03
