HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 31836 of 2025 Court No. - 34 HON'BLE ROHIT RANJAN AGARWAL, J.
1. The petitioner, before this Court, participated in auction for fisheries rights on 01.02.2023. Being the highest bidder, the bid was settled in his favour for Rs.70,000/-. The petitioner was required to deposit Rs.17,500/- i.e. 1/4th of bid money on the same day. He could not deposit the bid money on the same day and deposited the amount on 04.05.2023. The auction proceeding and settlement of bid in favour of petitioner was challenged by one Abdul Mannan by filing an appeal under Rule 59 of U.P. Revenue Code Rules, 2016 (hereinafter referred as "the Rules of 2016"). The appeal filed by Abdul Manna was allowed and the auction held in favour of petitioner was cancelled. Against the said order, a revision was filed which has been dismissed by order impugned. 2. Learned counsel for the petitioner submitted that petitioner had deposited the amount on the same day but the receipt was issued on
04.05.2023. The petitioner cannot be faulted for the fault of revenue authorities as 1/4th of bid money was deposited immediately on the same day. 3. Learned Additional Chief Standing Counsel has opposed the writ petition and submitted that auction had taken place on 01.02.2023. The receipt annexed as annexure no. 4 to the writ petition is dated 04.05.2023. According to learned Additional Chief Standing Counsel, 1/4th amount of bid money has been deposited after more than three months. The authorities have rightly allowed the appeal and rejected the revision filed by petitioner. 4. I have heard respective counsel for the parties and perused the material on record. 5. It is an admitted case that auction had taken place on 01.02.2023. The receipt which is the document of deposit of 1/4th of bid money has been filed by petitioner which clearly demonstrates that it is dated 04.05.2025. The 1/4th amount of bid money has been deposited after more than three months. The bid cannot be settled in favour of petitioner as Section 189 of U.P. Revenue Code, 2006 provides for depositing 1/4th of bid money immediately. The petitioner should have deposited the said amount on the same day.
If for the sake of argument, the contention of petitioner is accepted that he deposited 1/4th of bid money on the same day but receipt was issued after 3-4 days, the same cannot be accepted in view of annexure-4 which is receipt annexed by petitioner in his writ petition which demonstrates that date mentioned in receipt is 04.05.2023 which is three months later than the date of auction. 6. No case for interference is made out. 7. The writ petition is misconceived and stands dismissed. September 12, 2025 V.S.Singh WRIC No. 31836 of 2025 2 (Rohit Ranjan Agarwal,J.)
