The petitioner is auction purchaser of crop standing over part of Plot No. 1ka along with several other persons. His case is that the crop was illegally harvested by the encroachers of the said land. Therefore, the petitioner has applied for refund of the money deposited by him for purchase of the crop. 2. The State has placed instructions wherein the stand taken is that the amount cannot be refunded in view of order dated 15.5.2025 in PIL No. 805 of 2025 wherein the direction is that the sale proceeds shall remain in deposit and will not be permitted to be withdrawn without prior leave of the court. It is stated that in view of the order of the court in the aforesaid PIL, the prayer of the petitioner cannot be accepted. 3. Learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to make appropriate application in this regard in the pending PIL. 4. Accordingly, the writ petition is disposed of with liberty as prayed for.
