HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 2903 of 2025 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J.
1. This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to the respondents to make fair inquiry about misuse of government funds by the Village Pradhan (respondent No.4) for the rural development programme budget under the Mahatma Gandhi National Rural Employment Guarantee Act and other development for the social development of the village.
2. A perusal of the representation made by the petitioner (Annexure-2) dated 25.06.2025 indicates that he had made reference to several complaints made in the past and that the said complaints, after inquiry, were closed by the respondents, however, apparently, the petitioner being dissatisfied with the outcome of the previous complaints has filed the present complaint all over again and is seeking its investigation through present PIL. However, in the present PIL, the petitioner has failed to annex all the previous disposal of complaints made by the respondents.
3. Once the complaints made pertaining to the same subject matter already stand disposed of by the respondents, merely because the disposal is not that of the liking of the petitioner, cannot arm the petitioner to continue to file the same complaint all over again and seek its investigation by filing Public Interest Litigation. Versus Counsel for Petitioner(s) : Dileep Kumar Srivastava Counsel for Respondent(s) : C.S.C., Jagdish Pathak (S.C.), Pankaj Kumar Gupta Himanchal Kaushal .....Petitioner(s) State of U.P. and 3 others .....Respondent(s)
4. In the circumstances of the case, we do not find any reason to entertain the present petition. The same is, therefore, dismissed.
