By virtue of a judgement dated 09-09-2022, the writ court came to award compensation of an amount of Rs. 24,30,000/-(twenty-four lacs thirty thousand) along with interest @ 6% per annum from 2014 onwards in favour of the petitioners who had come forth claiming compensation on account of loss of life of Nazir Ahmad Khan, the husband of the petitioner No.1 and father of the petitioners No. 2 to 5, suffering electrocution on 24-07-2013 and consequently losing his life. 2. The petitioners came forward with the institution of this contempt petition on 16-12-2022 i.e., after expiry of intra-court appeal period available at the end of the writ-respondents to impugn writ court judgement. 3. This contempt petition is in state of wait for the writ respondents to come up with entire payment of the compensation amount along-with interest but, nevertheless, the same has not taken place for reasons which are being attributed to the administrative wrangles. 4. Be that is it may, in terms of an order dated 15-09- 2023, this Court came to have the personal appearance of Mr. Javed Yousuf, the then Chief Engineer Distribution, when it came to be stated by said Mr. Javed Yousuf that against the judgement of the writ court, the appellate remedy has been invoked but, nevertheless, time was sought for coming forward with the compliance of the writ court mandate. 5. This Court, in terms of an order dated 23-12-2024, came to register the presence of Mr. Ajaz Muzaffar, Executive Engineer, Electric Division, Baramulla who stated on record that principal compensation amount of Rs. 24.30 lacs has been received by him and given the fact that the appeal is also being pursued, though time barred, therefore, in order to save prejudice being caused to the right of the respondents in the context of the appeal so preferred, the principal amount of Rs. 24.30 lacs can be ordered by this Court to be deposited before the Registrar Judicial, Srinagar subject to outcome of the time barred letters patent appeal so preferred. 6. The plea of Mr. Ajaz Muzaffar, Executive Engineer, Electric Division, Baramulla is genuine and bear sense, as such, this Court directs Mr. Ajaz Muzaffar Executive Engineer, Electric Division, Baramulla to deposit the principal compensation amount of Rs. 24.30 lacs with the Registrar Judicial, Srinagar within a period of ten days without any fail, upon which deposit, said amount to be kept in a fixed deposit in the J&K Bank Branch High Court, Srinagar initially for a period of three months and thereafter extendable on its own until and unless recalled. 7. The final release of the amount along with the interest shall take place upon the outcome of the letters patent appeal. 8. The contempt petition is disposed of with liberty reserved to the petitioners to seek revival of the contempt petition upon final outcome of the time barred letter patent appeal preferred in the matter.
