(Through V.C.) *** ASHWANI KUMAR MISHRA, J. (ORAL) CM-4722-LPA-2019 This is an application filed under Section 5 of the Limitation Act for condonation of delay of 142 days in filing the appeal. Despite service of notice, no reply has been filed by learned counsel for the respondent. Delay in filing the appeal has been explained by the learned counsel for the appellants-UOI. In view of the explanation furnished and the assertions made, the application is allowed. Accordingly, the delay of 142 days in filing the appeal stands condoned. LPA-2056-2019 [1] The present appeal has been filed under Clause X of Letters Patent Appeal Act against the impugned order dated 16.05.2019 passed by the learned Single Judge in CWP-98-2015 titled as ‘Banarsi Lal versus Union of India and others’, whereby directions have been issued to RAJNEESH SHARMA 2025.09.23 10:25 I attest to the accuracy and integrity of this document LPA-2056-2019 (O&M) -2- reimburse the medical expenses incurred for treatment of respondent within a period of two months. [2] Learned Single Judge has allowed the writ petition and direction has been issued to process the claim of writ petitioner for medical reimbursement. [3] The writ petitioner had claimed voluntary retirement on account of his illness. The respondent-petitioner suffered a heart attack and was admitted for a long period at Chawla Heart Care Centre, Jalandhar. The medical bills of the said Centre were duly submitted, and the learned Single Judge allowed the writ petition, directing the release of the amount. Although an appeal was filed, but no interim order was granted. Consequently, the medical bills were released in favour of the respondent- petitioner on 22.02.2023. [4] Considering the facts and circumstances of the present case, as well as the subsequent developments, including the fact that the judgment of the learned Single Judge has been given effect to, we find no occasion to interfere in the present matter.
