The challenge in this petition is made to order dated 21.07.2025, by which the petitioner has been removed from service.

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner submits that the petitioner was appointed with the respondents-department as Junior Engineer on contractual basis in the year 2012. In the year 2020, he was appointed on ad-hoc basis. There was some enquiry pending against one Sudarshan Singh Rawat, but in the enquiry, some finding has been recorded against the petitioner, and without affording him an opportunity of hearing, he was removed from his service.

Learned State Counsel, very fairly, concedes that the matter may be remanded. He submits that the respondents may be given liberty to take fresh action in accordance with law, after affording an opportunity of hearing to the petitioner.

Since it is admitted that the order of removal of the petitioner from services has been passed without affording any opportunity of hearing to him, the impugned order dated 21.07.2025, deserves to be quashed and the writ petition deserves to be allowed.

The writ petition is allowed. The impugned order dated 21.07.2025, is quashed.

However, the respondents-authorities are at liberty to take fresh action against the petitioner, in accordance with law.
