At this stage, counsel for the appellants submits that he does not wish to pursue the appeal against respondents No.3 and 7. Accordingly, their names be struck-off from the array of respondents, subject to risk and cost of the appellants. Registry to make necessary corrections in the memo of parties. Let amended memo of parties be filed by the next date of hearing.

The present application under Section 5 of Limitation Act filed by the applicants-appellants to condone delay of 76 days’ in filing the appeal against the
judgment dated 02.01.2025 passed by learned Single Judge in CWP No.10187 of 2024, titled as Dr. Daaman Thakur and others Versus the State of Himachal Pradesh and others, has been opposed by
learned counsel for the private respondents, by filing reply.

However, keeping in view the nominal delay, as such in filing the appeal and the law laid down by the Apex Court in Land Acquisition, Anantnag & Anr. Versus M/s Katiji & Ors., (1987) 2 SCC 107 that each and every day’s delay is not to be explained, we are of the considered opinion that sufficient cause has been made out for condoning the delay in filing the appeal, which has been duly explained.

Accordingly, the present application is allowed and delay in filing the appeal is condoned.
Appeal be registered.
Application stands disposed of.
