1. After arguing for a while, the learned counsel appearing on behalf of the petitioner submits that he would feel satisfied, if the application which has been preferred by the petitioner, which is pending adjudication before the Deputy Commissioner, Kupwara, and Senior Superintendent of Police Kupwara, is directed to be brought to its logical conclusion and disposed of within some reasons timeframe.
2. While the matter was being argued, the learned counsel for the petitioner has drawn the attention of this Court to the communication dated 21-09-2022 addressed by the Divisional Commissioner Kashmir to the Deputy Commissioner Kupwara, and Senior Superintendent of Police Kupwara, dated 21st September 2022, wherein a direction has been issued to them to look into the matter and the accused be booked under the relevant law.
3. The learned counsel for the petitioner submits that till date the aforesaid application, which pertains to the demarcation of the land and also taking action against the culprits, has not been brought to its logical conclusion and the respondents have not moved an inch and feeling aggrieved of the inaction on part of the respondents, the instant petition has been preferred.
4. The learned counsel for the petitioner submits that the petitioner would feel satisfied, if the respondents are directed to accord due
consideration to the said application within some reasonable timeframe, to which Mr. Alla Ud Din Ganai, learned Additional
Advocate General is not averse, subject to the same is directed to be accorded consideration strictly under rules and as per law.
5. With the consent of the learned counsel for the parties, the writ petition is taken up for final disposal at this stage and is accordingly
disposed of with direction to the Respondents 3 and 5 to accord due
consideration to the application, which has been preferred by the petitioner, strictly under rules and as per law within a period of four weeks’ from the date copy of this order along with the writ petition and annexures thereto, are made available to the said respondents.
6. Writ petition is disposed of along with connected CM(s) in the manner as indicated above. ;
