(Oral) By means of the instant civil misc. transfer application, filed under Section 24 of the Code of Civil Procedure, 1908, the applicant seeks transfer of Original Suit No.743 of 2024, Pankaj Trivedi Vs. Smt. Ankita Trivedi (“the case”), from the court of Principal Judge Family Court, Dehradun to the court of Civil Judge (Sr. Div.), Rudraprayag. 2. The respondent was issued notice on 19.06.2025. This Court passed the following order, “Despite service of notice, there is no representation on behalf of the respondent. In the interest of justice, case is adjourned to 21.08.2025.” 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant submits that the applicant a resident of District Rudraprayag; the respondent is also resident of District Rudraprayag, who is presently serving in District Udham Singh Nagar and he has filed a suit for divorce in the court at Dehradun. It is submitted that in the transfer application, the address of District Udham Singh Nagar has been written by the applicant because it is address, which was written in 2 the suit by the respondent. He submits that it is quite difficult for the applicant to join the proceeding at Dehradun because it is 180 Kms; the applicant is dependent on his father. 5. Having considered the submissions, as made as well as considering the fact that the respondent did not choose to response despite service of notice, this Court is of the view that the case may be transferred from the court of Principal Judge Family Court, Dehradun to the court of Civil Judge (Sr. Div.), Rudraprayag. Accordingly, civil transfer application deserves to be allowed. 6. Civil transfer application is allowed. 7. Original Suit No.743 of 2024, Pankaj Trivedi Vs. Smt. Ankita Trivedi is transferred from the court of Principal Judge Family Court, Dehradun to the court of Civil Judge (Sr. Div.), Rudraprayag. 8. Let a copy of this order be sent to both the courts.
