The petitioner has been made accused in connection with Mandu (Kuju) P.S. Case No.170 of 2023 corresponding to S.T. Case No.33 of 2024 registered under Sections 302/307/34 of the Indian Penal Code and under Section 27 of the Arms Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with the co-accused persons went to the construction site of the informant and started demolishing his boundary wall and when the informant opposed, the petitioner shot Janki Yadav and Pawan Yadav resulting in death of Janki Yadav. It is submitted that the allegation against the petitioner is false. It is next submitted that for the self- same occurrence, from the side of the petitioner, the brother of the petitioner namely Rajesh Giri lodged Mandu (Kuju) P.S. Case No.175 of 2023 in which the said Janki Yadav is one of the accused persons. It is next submitted that in the said occurrence, the petitioner was also a victim and sustained grievous injuries and was underwent treatment as indoor patient, in a private hospital from 13.08.2023 to 23.08.2023. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 23.08.2023 as is mentioned in para-26 of the instant bail application and though charge has been framed on 30.03.2024 but not even a single witness has been examined during the trial, as yet. It is next submitted that the co-accused person has already been released on bail by a co-ordinate bench of this Court vide order dated 16.05.2024 in B.A. No.3888 of 2024. It is next submitted that the petitioner undertakes that he will not annoy or disturb the informant or his family members in any manner and will not go to the place of occurrence during the pendency of the case. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Ramgarh in connection with Mandu (Kuju) P.S. Case No.170 of 2023 corresponding to S.T. Case No.33 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not go to place of occurrence during the pendency of the case.
