For the Respondent(s) : Mr. Manoj Kumar, Advocate ----- 03/ 16.04.2025 Heard the parties. 2. By filing this Criminal Writ Petition, the petitioner prays that a direction may be given to the respondents to investigate the matter in connection with Chutia P.S. Case No.24 of 2025 registered under Sections 127 (2)/ 114(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 in a proper manner. 3. It is the grievance of the petitioner that the respondents on one hand is not properly investigating the allegation made by this petitioner, and on the other hand a case bearing Chutia P.S. Case No.23 of 2025 has been instituted against this petitioner and his wife. 4. Learned counsel representing the petitioner submits that the Investigating Officer is not properly investigating the matter in connection with Chutia P.S. Case No.24 of 2025, and the same may be directed to be conducted in a proper manner. 2025:JHHC:11547 2 5. The prayer made by the petitioner is absolutely misconceived at this stage. There cannot be a presumption that the Police is not investigating the F.I.R. lodged by the petitioner in a proper manner. However, if the petitioner has any grievance, he may approach the Superintendent of Police or the Supervising Authority, as the case may be. 6. This Court cannot monitor investigation of any case on the request of the party. 7. Accordingly, this Criminal Writ Petition is dismissed with the aforesaid liberty. (ANANDA SEN, J.) Prashant. Cp-3
