Sri Manoj Kumar Srivastava, (AOR No. A/M0888/2013) holding brief of Sri Pramod Kumar Srivastava, learned counsel for the applicant on instructions received from his client submits that though the application u/s 528 BNSS has been preferred by the applicant for quashing entire proceeding of Case No. 97023 of 2024 (Manoj Kumar Srivastava Vs. Shyam Bahadur Yadav) as well as summoning order dated 4.12.2024 passed by VII Additional Chief Judicial Magistrate, Varanasi under section 138 Negotiable Instrument Act, Police Station- Shivpur, District- Varanasi, pending in the court of VII Additional Chief Judicial Magistrate, Varanasi, however, he confines his relief only to the extent of enlargement of bail before the court below. 2. Learned A.G.A. has no objection to the same. 3. Considering the submissions raised at the Bar and the statements so sought to be made by them, the application stands disposed of while observing that in case appropriate proceeding in the form of bail application is preferred before the court below, then the same shall be decided with most expedition strictly in accordance with the law of the land keeping in view the judgment in the case of Satender Kumar Antil Vs.
