Hon’ble Mr. Justice Mohd Yousuf Wani, Judge ORDER 25.04.2025 CM No. 2353/2025: This is an application filed by the petitioner seeking withdrawal of the writ petition with liberty to file fresh one on the ground that there is some subsequent development having direct bearing on the controversy raised in this petition. It may be noted that this petition was entertained by this Court and vide order dated 24.12.2024, this Court while issuing notice to the respondents and providing them an opportunity to file response, had also issued interim order directing the petitioner not to put the land in question to non-agricultural use. The petitioner now submits that after passing of the aforesaid order and during the pendency of this petition, fresh order has been passed by the respondents which necessitates the filing of the fresh petition. The application for the reasons stated therein is allowed with liberty to file fresh one provided there is a subsequent development in the matter. We, however, make it clear that till the fresh petition which is filed by the petitioner is taken up for consideration by the Court, the interim order dated 24.12.2024 shall remain in operation.
