HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 33057 of 2025 Court No. - 39 HON'BLE ARINDAM SINHA, J.
HON'BLE ARUN KUMAR SINGH DESHWAL, J.
1. Mr. Pradeep Kumar Yadav, learned advocate appears on behalf of petitioner and submits, his client is operating a petrol pump. The electricity connection is under category, rural. The petrol pump is not running properly. Prayer is for getting supply as a consumer under industrial category. Mr. Ashim Mukerjee, learned advocate, Standing Counsel appears on behalf of State and Mr. Narendra Kumar Tiwari, learned advocate, on behalf of respondent nos. 2 to 5 (the supply company). Mr. Tiwari submits, it is a rural area and connection was accordingly given. Petitioner is not an industry. Industrial supply, therefore, cannot be given. He submits further, petitioner does not have requirement of 500 KV or more, the essential requirement for industrial supply.
2. Our understanding of petitioner's grievance is, low and fluctuating voltage that is affecting running of the pump. At this stage we leave it to the supply company to improve the supply as on query Mr. Tiwari submits, petitioner's requirement is being met from the existing category of supply (rural). In the circumstances we make no order, reserving liberty to petitioner to produce prima facie demonstration of low and fluctuating voltage continuing, in event he again wants to move this Court. Petitioner must allow for two months' time before he can again approach. We make it clear, there has to be demonstration of low and fluctuating voltage on the Versus Counsel for Petitioner(s) : Babu Ram Yadav, Pradeep Kumar Yadav Counsel for Respondent(s) : C.S.C., Narendra Kumar Tiwari Gyan Chandra Yadav .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s)
