The Criminal Petition has been filed under Sections 480 and 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 (for brevity ‘the B.N.S.S’) seeking to enlarge the petitioners/accused Nos.1, 4 and 6 on bail in Crime No.17 of 2004 of Sileru Police Station registered for the offence punishable under Sections 20(b)(ii)(C), 25 r/w 8(c) of Narcotic Drugs and Psychotropic Substances, 1985 (for brevity ‘the N.D.P.S. Act’) and Section 111(2) (b) of Bharatiya Nyaya Sanhita (for brevity ‘the BNS’) for possession and transportation of

Kg.223.100 grams of Ganja which was seized under the cover of mediators report. The petitioners were arrested on 03.10.2024 and have been in the judicial remand. 2. Heard Sri G. Maheswara Rao, learned counsel for the petitioners and Ms. P. Akila Naidu, learned Assistant Public Prosecutor. 3. Perused the record. 4. The petitioners have been in the judicial custody for the past 184 days. As per Section 36A (4) of ‘the N.D.P.S. Act’, the accused involved in commercial quantity is entitled for default bail after completion of 180 days in the judicial custody. Thus, petitioners are entitled for default bail. Therefore, request of the petitioners is required to be considered positively. 5. In the result, the criminal petition is allowed with the following conditions: i. The petitioners shall be enlarged on bail subject to they execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned I Additional District & Sessions Judge- Special Judge for Trial of Offences under ‘the N.D.P.S. Act’, Visakhapatnam. ii. The petitioners shall appear before the Station House Officer, Sileru Police Station on every Saturday between 10 am and 5
