(Oral) The prayer in the present petition under Section 482 Cr.P.C. is for quashing of the impugned order dated 11.07.2018 (P-5 ) passed by the Judicial Magistrate Ist Class, Hoshiarpur and all consequential proceedings arising therefrom where the petitioner has been declared a proclaimed person in a cross-case registered vide DDR No. 9 dated 12.05.2015 under Sections 323, 324, 34 IPC, Police Station Chabbewal, arising out of FIR No. 44 dated 11.05.2015 under Sections 323, 324, 326, 148 and 149 IPC, Police Station Chabbewal, District Hoshiarpur. 2. On 30.10,.2023, the following order was passed:- Notice of motion. SUKHPREET KAUR 2025.09.05 01:41 I attest to the accuracy and integrity of this document chandigarh CRM-M-53930-2023 ::2:: On advance service of copy of the petition, learned State counsel appears and accepts notice on behalf of respondent- State of Punjab and seeks time to file report. At request, adjourned to 13.12.2023. Meanwhile, operation of the impugned order dated 11.07.2018 vide which the petitioner was declared as a proclaimed person shall remain stayed. 3. Thereafter, the matter was adjourned from time to time. 4. On 06.08.2025, the following order was passed:- On 30.10.2023, the following order was passed:- “Notice of motion. On advance service of copy of the petition, learned State counsel appears and accepts notice on behalf of respondent-State of Punjab and seeks time to file report. At request, adjourned to 13.12.2023. Meanwhile, operation of the impugned order dated 11.07.2018 vide which the petitioner was declared as as proclaimed person shall remain stayed.” As the order declaring the petitioner a proclaimed offender has been stayed, the petitioner is directed to appear before the Trial Court within a period of 02 weeks from today and on his appearing, he shall be admitted to interim bail to the satisfaction of the Trial Court. Adjourned to 02.09.2025. A copy of the order granting interim bail to the petitioner be produced on the next date of hearing. 5. Today, the Court has been apprised that the petitioner has been granted the concession of interim bail.
