HIGH COURT OF UTTARAKHAND AT NAINITAL Writ Petition No. 2270 of 2025 (M/S) Pankaj Kumar Gupta ….....Petitioner Versus State of Uttarakhand and Others ….….Respondents Present:- Mr. Avidit Noliyal, Advocate for the petitioner. Mr. Suyash Pant, Standing Counsel for the State. Hon’ble Ravindra Maithani, J. (Oral) It is the case of the petitioner that he had purchased a property in Dehradun. The petitioner stays in Delhi. Recently, when he visited Dehradun, he saw that some persons have illegally encroached upon his property. By means of the instant petition, the petitioner seeks directions that the illegal encroachment from his property may be removed and respondents may take appropriate action against the encroachers. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the petitioner submits that the petitioner had given a representation to the respondents-authorities. They may be directed to decide it. 4. The dispute, which has been raised in the present writ petition, is absolutely civil in nature. The petitioner claims ownership over the property, and according to him, some persons have encroached upon the property. The petitioner may very well be advised to file a suit seeking appropriate remedy before the civil court. Therefore, there is no reason to entertain the writ petition and it deserves to be dismissed at the stage of admission itself. 2 5. The writ petition is dismissed in limine.
