Heard counsel for the petitioners, Additional Government Advocate for the State and Sri Anmol Kumar Dubey, holding brief of Sri Ishwar Chandra Tyagi for respondent no. 4. 2. The present petition has been filed challenging the First Information Report dated 29.08.2025 registered as Case Crime No. 0460 of 2025, under Sections 108, 191(2), 115(2), 352, 351(2) and 127(2) of B.N.S., Police Station Amroha Nagar, District Amroha. 3. Contention of the learned counsel for the petitioners is that the case of the petitioners is absolutely similar to the case of petitioner in Criminal Misc. Writ Petition No. 20370 of 2025 in which he has been granted relief by this Court on 11.09.2025. 4. Matter requires consideration. 5. Respondents may file counter affidavit within a period of three weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter. 6. List thereafter. 7. Till the next date of listing or till the submission of Police report under Section 173(2) Cr.P.C. (now section 193(3) of Bhartiya Nagrika Suraksha Sanhita, 2023) whichever is earlier, the petitioners shall not be arrested. The petitioners will cooperate with the investigation. In the event they fail to do so, the police shall be at liberty to move an application before this Court.
