With the consent of rival parties, at this stage, this writ petition is disposed of with an observation that since departmental proceedings has been initiated probably on similar circumstances on which an FIR was also lodged against the petitioner, therefore, at this stage, respondents have to take a decision whether to continue a departmental proceedings or not in terms of judgment passed by Supreme Court in Capt. M. Paul Anthony vs. Bharat Gold Mines Ltd. and Another, (1999) 3 SCC 679, therefore, this writ petition is disposed of with an observation that concerned respondents will take a reasoned decision whether to continue departmental proceedings or not in terms of Capt.
