Heard the parties.
The petitioners have been made accused in connection with Palkot P.S. Case No. 46 of 2024 for the offences registered under sections 310(4) and 310(5) of the B.N.S. and Sections 25(1-b) A, 26/35 of the Arms Act, pending in the court of learned Additional Chief Judicial Magistrate, Gumla. On 04.10.2024 at about 1:10 A.M., Palkot police received a confidential information that some criminals have assembled near Bangru Pahar and were making preparation for commit dacoity. On the basis of this information, place of occurrence was raided and co-accused persons were apprehended. It was submitted that nothing incriminating has been recovered from the possession of the petitioner No.1 Kishun Besra @ Kishun Lohra, while loaded pistol was recovered from the possession of petitioner No.2 Sudhir Kumar Sah. It was further submitted that accused persons are in custody for more than six months. It was finally submitted that similarly situated co-accused persons have been granted bail by this Court earlier. In view of the submission made above, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Gumla, in connection with Palkot P.S. Case No. 46 of 2024.
