2. Mr. Bhaskar Chandra Joshi, learned A.G.A. with Mr. Vipul Painuli and Ms. Sweta Badola Dobhal, learned Brief Holder for State of Uttarakhand/respondent Nos.1 to 3.
3. By means of the present criminal writ petition, petitioners have challenged the FIR No.49 of 2020 dated 30.08.2020 registered with Police Station Mallitaal, District Nainital under Sections 420 and 406 IPC.
4. It is contended by the learned State Counsel that after investigation, a final report has already been filed by the police against the private respondents on 04.05.2023, therefore, nothing survives in this writ petition and it becomes infructuous.
5. In view of the statement made by learned State Counsel, the present criminal writ petition is dismissed as infructuous.
